What is Vehicular Homicide?
If the death of any person happens as a result of an injury caused by a person driving a vehicle, the person driving the vehicle is guilty of vehicular homicide. For the death to be considered vehicular homicide, it must have occurred within three years of the accident and as a result of the injury.
The driver is guilty of vehicular homicide if the driver was operating a motor vehicle while under the influence of an intoxicating liquor or any drug, driving in a reckless manner, or driving with disregard for the safety of others.
What is the Punishment?
Vehicular homicide is a class A felony. A class A felony is punishable by imprisonment for up to life, a $50,000.00, or both.
If the vehicular homicide was committed by a person under the influence of an intoxicating liquor or drug, two years are added to the sentence.
