What is Sexual Exploitation of a Minor?
A person is guilty of sexual exploitation of a minor if he or she compels a minor by threat or force to engage in sexually explicit conduct, knowing that such conduct will be photographed or part of a live performance; aids, invites, employs, authorizes, or causes a minor to engage in sexually explicit conduct, know that such conduct will be photographed or part of a live performance; or being a parent, legal guardian, or person having custody or control of a minor, permits the minor to engage in sexually conduct, knowing that the conduct will be photographed or part of a live performance.
A minor is defined by any person under eighteen years of age.
Sexually explicit conduct includes but is not limited to, actual or simulated sexual intercourse, penetration of the vagina or rectum by an object, masturbation, or defecation or urination for the purpose of sexual stimulation of the viewer.
What is the Punishment?
Sexual exploitation of a minor is a class B felony. A class B felony is punishable by imprisonment for up to ten years, a fine of up to $20,000.00, or both.
Additionally, you could be required to register as a sex offender.
What is the Sex Offender Registry?
Any adult residing whether or not the person has a fixed residence, or who is a student, is employed, or works in the State of Washington, who has been found to have committed or has been convicted of any sex offense, shall register with the county sheriff for the county of the person’s residence, or if the person is not a resident of Washington, the county of the person’s school or place of employment. When registering you must provide your name, residential address, date and place of birth, place of employment, crime for which convicted, date and place of conviction, social security number, photograph, and fingerprints.
