Washington Negligent Driving Charges and Penalties
What is Negligent Driving?
A person is guilty of negligent driving in the first degree if he or she operates a motor vehicle in a manner that is both negligent and endangers, or is likely to endanger, any person or property and exhibits the effects of having consumed liquor or marijuana, for its intoxication or hallucinatory effects.
A person is guilty of negligent driving in the second degree if, under circumstance not constituting negligent driving in the first degree, he or she operates a motor vehicle in a manner that is both negligent and endangers or is likely to endanger any person or property.
“Negligent” means the failure to exercise ordinary care and doing some act that a reasonably careful person would not do under the same or similar circumstances, or the failure to do something that a reasonably careful person would do under the same or similar circumstance.
What is the Punishment?
Negligent driving in the first degree is a misdemeanor.
Negligent driving in the second degree is a traffic infraction.
A traffic infraction is punishable by a fine of $250.00.
A misdemeanor is punishable by imprisonment for not more than ninety days, a fine of not more than $1,000.00, or both.
Additionally, negligent driving can be charged with additional crimes such as driving under the influence or speeding. There are sometimes instances where a charge can be dropped or lessened, or just one charge be kept with the other dropped; it is important to have an attorney who knows how to navigate the criminal justice system and how to take those actions.
