What is Criminal Attempt?

A person is guilty of attempting to a commit a crime if they have intent to commit a specific crime and take a substantial step toward the commission of that crime.

Examples of criminal attempt include, but are not limited to, planning and attempting to rob a bank, or planning and attempting to murder someone. Another example includes putting a lipstick in your purse with the intent to steal it and getting caught.

What is the Penalty for Criminal Attempt?

The punishment for criminal attempt depends on the crime that was attempted.

Criminal attempt is a class A felony when the crime attempted is murder in the first or second degree, arson in the first degree, child molestation in the first degree, indecent liberties by forcible compulsion, rape in the first or second degree, or rape of a child in the second degree.

Criminal attempt is a class B felony when the crime attempted is punished as a class A felony besides the crimes listed above.

Criminal attempt is a class C felony when the crime attempted is punished as a gross misdemeanor.

Criminal attempt is a misdemeanor when the crime attempted is punished as a gross misdemeanor or misdemeanor.

A class A felony is punishable by imprisonment for up to life, a fine of up to $50,000.00, or both.

A class B felony is punishable by imprisonment for up to ten years, a fine of up to $20,000.00, or both.

A class C felony is punishable by imprisonment for up to five years, a fine of up to $10,000.00, or both.

A gross misdemeanor is punishable by imprisonment for up to 364 days, or a fine of up to $5,000.00, or both.

A misdemeanor is punishable by imprisonment for up to ninety days, or a fine of up to $1,000.00, or both.
