Washington Boating Under the Influence Charges and Penalties

What is Boating Under the Influence?

A person is guilty of boating while under the influence of intoxicating liquor, marijuana, or any drug if the person operates a motorized or non-motorized boats (which includes, kayaks, canoes and rafts) within Washington.

The legal limit for operating under the influence of alcohol on Washington State waterways is .08 and the legal limit for boating under the influence of marijuana is 5.0 nanograms.

What are the Penalties?

Boating under the influence is a gross misdemeanor.

A gross misdemeanor is punishable by imprisonment for up to 364 days, or a fine of up to $5,000.00, or both.

The penalty can vary depending on how much alcohol or drugs were in your system, if you committed an additional crime like vehicular homicide, if you had passengers in your car, or if you have had prior convictions of boating under the influence before.

Additionally, the court can require you to attend a sobriety program, attend a counseling program.
