What is the Statute?
Under Utah Code §41-6a-528, a person is guilty of reckless driving who operates a vehicle:
- In willful or wanton disregard for the safety of persons or property; or
- While committing three or more moving traffic violations, in a series of acts occurring within a single continuous period of driving covering three miles or less in total distance.
What are moving traffic violations and reckless driving?
Moving traffic violations and reckless driving could include but are not limited to the following offenses:
- Speeding;
- Failure to give right of way to pedestrians;
- Failure to use a turning signal;
- Swerving through traffic;
- Suddenly slamming on the breaks;
- Honking your horn for no apparent reason;
- Participating in a race;
- Swerving over into a lane already occupied by a vehicle; or
- Failure to stop at a stop sign.
What is the Punishment?
Reckless driving is a class B misdemeanor. A class B misdemeanor in the state of Utah is penalized by up to six months in jail and a fine of up to $1,000.00.
Another important thing to note is that a reckless driving citation carries points and can affect your ability to keep your license. A reckless driving citation in the state of Utah carries 80 points on your license. Additionally, you can be charged with other citations along with your reckless driving citation. This can make points accumulate extremely quickly.
Unless you have a special license, such as a commercial motor vehicle license, and you get three hundred points or more on your Utah driver license, your license could be suspended. Losing your ability to drive can create a big problem when you rely on driving to get to work, get essential things like groceries, or even if you need to transport your children.
