Failure to Stop Crimes Defense

In Utah, if you receive a citation for Failure to Stop, also referred to as Failure to Yield, you could be facing penalties that can affect your driver’s license for years. What is the Statute? 

Unless you are being directed by a police officer, if you are approaching a stop sign while driving a motor vehicle you must:

  • Stop at a clearly marked stop line;
  • Stop before entering a crosswalk on the near side of the intersection if there is not a clearly marked stop line; or
  • Stop at a point nearest the intersecting roadway where you can see approaching traffic, if not crosswalk or stop line exist.

After stopping, you must yield the right-of-way to any vehicle in the intersection or approaching on the other side of the roadway and you must always give pedestrians the right of way. 

It is important to note that you can be cited for failure to yield or stop if you do not slow down to a reasonable speed for existing conditions when approaching a yield sign. For example if you know it is icy and break too late, you might slide into the intersection, or if you are in a busy part of town and have reason to believe a pedestrian is trying to cross the street, you might not be able to stop in time. It can create a dangerous situation very quickly.

What is the Penalty?

If you are convicted of failure to stop in the state of Utah, it is considered an infraction. Most small traffic citations in Utah are considered infractions. An infraction is a lesser charge then a misdemeanor, but that does not make it any less serious to have on your record. Any blemish on your record can effect things in your life. A failure to yield citation can have an effect on your driving record and your wallet.

An infraction is punishable by a fine of up to $750.00.

Another important thing to note is that a failure to yield citation carries points and can affect your ability to keep your license. Failure to yield citations carry 60 points.

Unless you have a special license, such as a commercial motor vehicle license, and you get three hundred points or more on your Utah driver license, your license could be suspended.
