Sexual Solicitation Crimes Defense

Soliciting a prostitute in Colorado can have consequences that could affect you for the rest of your life. 

WHAT IS PROSTITUTION?

Under CRS 18-7-201:

Any person who performs or offers or agrees to perform any act of sexual intercourse, cunnilingus, masturbation, or anal intercourse with any person in exchange for money commits prostitution. Basically, engaging in a sexual act in exchange of money, goods, or other services.

WHAT CONSTITUTES AS SOLICITING A PROSTITUTE?

Under CRS 18-7-202:

Committing solicitation of a prostitute constitutes arranging or offering to arrange a meeting of persons for the purpose of prostitution. It can also mean directing another to a place knowing such direction is for the purpose of prostitution. 

This can mean the most common scene found in movies of having a prostitute come up to your car to strike a deal. But usually, in today’s electronic age it can also mean texting, emailing, or even responding to advertisements knowing that the purpose is for sexual acts for money. 

WHAT ABOUT SOLICITING FOR CHILD PROSTITUTION?

Soliciting for child prostitution is extremely similar to solicitation of a prostitute but it involves a child, who is a “person under the age of 18 years old.”

WHAT IS THE PENALTY?

Solicitation of a prostitute is considered a class 3 misdemeanor in the state of Colorado. It may be penalized by a fine of not more than five thousand dollars plus an additional $50 dollar fine, six months imprisonment, or both.

Soliciting for child prostitution is a class 3 felony in the state of Colorado. It may be penalized by imprisonment of four to eight years plus one year of parole and a fine of $3,000 to $750,000, or both. 

Additionally, if you have a record for solicitation, said record could hinder your chances of working in certain places, such as with children, banks, or even a charitable organization.
