Interrupt of Electronic Communication Device Defense
In Colorado, it is against the law to interrupt any electronic communication device. A charge involving interruption of electronic communication devices can come with fines and a spot on your record.
What is the Statute?
Under CRS 18-9-306.5, a person commits obstruction of telephone or telegraph service if the person knowingly prevents, obstructs, or delays, by any means whatsoever, the sending, transmission, conveyance, or delivery in this state of any message, communication, or report by or through any telegraph or telephone line, wire, cable, or other facility or any cordless, wireless, electronic, mechanical, or other device.
These types of acts of destruction, obstruction, or delaying could include but are not limited to, pulling a phone line out of a house, cutting a phone line, destroying a communication device, or taking, damaging, or disabling a phone out of someone’s hands who is trying to call for help or has voiced the desire to call for help or emergency aid. Help can include, medical, law enforcement, and fire department. Often times this charge can be coupled with other charges, including domestic violence.
What is the Penalty?
An obstruction of telephone or telegraph service is considered a class 1 misdemeanor. A class 1 misdemeanor in the state of Colorado is punishable by six to 18 months in jail, a fine of $500 to $5,000, or both.
