California Intimidating a Witness Charges and Penalties

What is Witness Intimidation?

Any person who knowingly and maliciously prevents, attempts to prevent, or dissuades any witness or victim from attending or giving testimony at any trial, proceeding, or inquiry authorized by law, is guilty of witness intimidation.

Any person who knowingly and maliciously prevents, attempts to prevent, or dissuades by using force or by an expressed or implied threat of force to any witness or victim from attending or giving testimony at any trial, proceeding, or inquiry authorized by law, is guilty of witness intimidation.

What is the Penalty?

If the intimidation does not include force or threat of force, it is punishable by up to a year of imprisonment. If the intimidation includes force or threat of force, it is punishable by imprisonment for two to four years and is considered a felony offense.
