What is Welfare Fraud?
In the state of California, any person who willfully and knowingly, with the intent to deceive, makes a false statement or representation or knowingly fails to disclose a material fact in order to obtain aid under the provisions of this division or who, knowing he or she is not entitled thereto, attempts to obtain aid or to continue to receive aid to which he or she is not entitled, or to receive a larger amount than that to which he or she is legally entitled, is guilty of welfare fraud.
If you put down a different amount then what you make in order to get more welfare help, like food stamps, or disability, that is welfare fraud. If you say you have more children then you do in order to receive more welfare benefits, that is welfare fraud.
What are the Penalties?
There are a variety of penalties that a person found guilty of welfare fraud may face depending on the monetary value of the aid that was obtained.
A person who is found guilty of welfare fraud where the total amount of aid obtained or retained is $950.00 or less, they can be punished by imprisonment for up to six months, by a fine of not more than $500.00, or both.
A person who is found guilty of welfare fraud where the total amount of aid obtained or retained is more than $950.00, can be punished by imprisonment for sixteen months to three years, a fine of up to $5,000.00, or both.
There are other crimes also associated with welfare fraud that a person could be charged with. These crimes include identity theft and even forgery. Each of these charges carries a different penalty. So on top of a welfare fraud charge, you could potentially be facing another serious charge.
