Has your child been cited for Underage Drinking? Their record could be in jeopardy!

In California, it is against the law to consume or be in possession of alcohol if you are younger then 21 years old. There are instances where it is not against the law and there are ways that Weber Law can help you get the answers you are looking for and get the best outcome for your child.

California Underage Drinking Charges and Penalties

What is Underage Drinking?

Any person under 21 years of age who possesses any alcoholic beverage on any street or highway or in any public place or in any place open to the public, is guilty of underage drinking.

“Possession of alcoholic beverage” means an underage person holding any amount of alcohol anywhere on their person or that has alcohol in their immediate presence and control.

Are there exception?

The exceptions to this statute include but are not limited to:

    1.) Consumption for religious purposes.

2.) A parent or legal guardian of a person under twenty-one years of age gave or permitted the possession and consumption of alcohol to the underage person.

3.) Consuming food that had alcohol in it in a small amount.

4.) If they are in possession of alcohol by order of a parent, responsible adult relative, or any other adult designated in pursuance of employment.

What is the Penalty?

There are different punishments depending on the circumstances around the charge of assault.  Assault is generally punishable by a fine not exceeding $1,000.00, imprisonment for up to 6 months, or both.

However, if assault is committed against certain people, the penalty can be more severe. When assault is committed against a peace officer, firefighter, emergency medical technician, lifeguard, physician or nurse, process server, juror, or even animal control officer who are engaging in their duties at the time of the assault, the penalty is a fine of up to $2,000.00, imprisonment for up to 6 months, or both.

There are ways to fight this more severe penalty, such as not knowing that they were working in such capacity, but it is difficult to fight without adequate legal counsel. Weber Law’s team has experience working with these charges; they know the ins and outs of the criminal justice system and what the best next steps are.
