California Speeding Charges and Penalties
What constitutes as Speeding?
No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent, having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.
No person shall drive a vehicle upon a highway with a speed that is greater than that speed limit.
What is the Penalty?
The penalty for speeding depends on the speed you were going.
It is an infraction to be found guilty of speeding. The penalty is a fine based upon the speed you were going.
A person who is found guilty of speeding greater than 100 miles per hour is guilty of an infraction which is punishable by a fine of not more than $500.00. If it is not the first time a person has been convicted of speeding 100 miles per hour or more, it is punishable by a fine of up to $750.00 and license suspension.
It is possible to fight a speeding ticket, or get a fine reduced, but it requires knowledgeable legal counsel who will advocate for you for the lowest fine possible.
