What is Sexual Exploitation of a Minor?
A person is guilty of sexual exploitation of a child if he or she knowingly develops, duplicates, prints, or exchanges any representation of information, data, or image, including, but not limited to, any film, filmstrip, photograph, negative, slide, photocopy, videotape, video laser disc, computer hardware, computer software, computer floppy disc, data storage media, CD-ROM, or computer-generated equipment or any other computer-generated image that contains or incorporates in any manner, any film or filmstrip that depicts a person under the age of 18 years engaged in an act of sexual conduct.
Sexual conduct is sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex or between humans and animals; penetration of the vagina or rectum by any object; masturbation for the purpose of sexual stimulation of the viewer; sadomasochistic abuse for the purpose of sexual stimulation of the viewer; exhibition of the genitals or the pubic or rectal area of any purpose for the purpose of sexual stimulation of the viewer; defecation or urination for the purpose of sexual stimulation of the viewer.
What is the Punishment?
A person who is found guilty of sexual exploitation of a minor can be punished by a fine of not more than $2,000.00, imprisonment for up to a year, or both, plus a longer sentence if it is not the first conviction of the person for this crime.
Additionally, you will be required to register as a sex offender. The length of registration ranges from ten years to life.
What is the Sex Offender Registration Act?
Every person who has been convicted in any court in California, or in any federal, or military court of various acts outlined above must register to the chief of police in which the person is residing, or the sheriff of the county if the person is residing in an unincorporated area or city that has no police department, and, additionally, with the chief of police of a campus of the University of California, the California State University, or community college if the person is residing upon the campus or in any of its facilities, within five working days of coming into, or changing the person’s residence within, any city, county, or city and county, or campus in which the person temporarily resides.
