California Sexual Battery Charges and Penalties

What is Sexual Battery?

In California, any person who touches an intimate part of another while that person is unlawfully restrained by the accused or an accomplice, and if the touching is against the will of the person touched is for the purpose of sexual arousal, sexual gratification, or sexual abuse, is guilty of sexual battery. There are other specifics that also encompass sexual battery which include:

1.Any person who touches an intimate part of another person who is institutionalized for medical treatment and who is seriously disabled or medically incapacitated, if the touching is against the will of the person touched, and if the touching is for the purpose of sexual arousal, sexual gratification, or sexual abuse is guilty of sexual battery;

2.Any person who touches an intimate part of another person for the purpose of sexual arousal, sexual gratification, or sexual abuse, and the victim is at the time unconscious of the nature of the act because the perpetrator fraudulently represented that the touching served a professional purpose is guilty of sexual battery.

3.Any person who for the purposes of sexual arousal, sexual gratification, or sexual abuse, causes another against that person’s will while that person is unlawfully restrained by either by the accused or an accomplice is for the specific purpose of sexual arousal, sexual gratification, or sexual abuse, is guilty of sexual battery.

A main aspect of the crime of sexual battery is committing the act for sexual arousal, sexual gratification, or sexual abuse. It is also important to note that sexual battery is different from California Penal Code § 261, Rape.

What is the Punishment?

Sexual battery is punishable by imprisonment for not more than one year, and a fine of not more than $2,000, or by imprisonment for two to four years, and by a fine not exceeding $10,000.00.  However, if the defendant was an employer and the victim an employee of the defendant then the punishment shall be a fine of not more than $3,000.00, and imprisonment of up to six months, or both.

If you have been convicted of a felony before and committed sexual battery against a minor, then it is punishable by imprisonment for two to four years and a fine not exceeding $10,000.00.
