California Object Rape Charges and Penalties
What is Object Rape?
A person is guilty of object rape when they, without the victim’s consent, cause penetration, however slight, of the genital or anal opening of another person who is fourteen years of age or older, by any foreign object, substance, instrument, or device, including apart of the human body other than the mouth or genitals, with intent to cause substantial emotional or bodily pain to the victim or the intent to arouse or gratify the sexual desire of any person.
Object rape can include finger penetration or penetration with an actual object.
What is the Punishment?
Object rape is a very serious charge. It is considered a violent felony.
The felony of object rape in California is punishable by imprisonment of three to eight years. If the victim is under fourteen years of age, the imprisonment can be eight to twelve years. A fine can also be imposed by the court.
If this is not your first serious sexual offense conviction, you could be sentenced to life in prison without parole.
An important thing to note is that object rape can be charged with other crimes including sexual battery, or even sexual assault. Every person who has been convicted in any court in California, or in any federal, or military court of various acts outlined above must register to the chief of police in which the person is residing, or the sheriff of the county if the person is residing in an unincorporated area or city that has no police department, and, additionally, with the chief of police of a campus of the University of California, the California State University, or community college if the person is residing upon the campus or in any of its facilities, within five working days of coming into, or changing the person’s residence within, any city, county, or city and county, or campus in which the person temporarily resides
