What is a Lewd or Lascivious Act?
In California, statutorily, it is called lewd or lascivious acts with a child but is most commonly referred to as child molestation. It is defined as an act upon or with the body, or any part or member thereof, of a child who is under the age of fourteen years, with the intent of arousing, appealing to, or gratifying the lust, passions, or sexual desires of that person or the child is a lewd or lascivious act, aka child molestation.
There are elements to the crime that increase the severity. These elements include the acts described above that are performed by use of force, violence, duress, menace, or fear of the immediate and unlawful bodily injury on the victim or another person; the person being a caretaker of the victim; or if the victim is a child of 14 or 15 years, and the person is at least 10 years older than the child. Consent is not a factor in these cases as a minor cannot legally consent.
What is the Punishment?
Lewd or lascivious acts with a child is a felony in the State of California. The severity of the crime does affect the punishment.
• A person who is found guilty of performing an act upon or with the body, or any part or member of a child who is under the age of fourteen years, with the intent of arousing, appealing to, or gratifying the lust, passions, or sexual desires of that person can be punished by imprisonment of three to eight years.
• A person who commits lewd or lascivious acts with a child while using force, violence, duress, menace, or fear of the immediate and unlawful bodily injury on the victim or another person can be punished by imprisonment for five to ten years.
• A person who commits lewd or lascivious acts with a child and is the child’s caretaker can be punished by imprisonment for four to ten years.
• A person who commits lewd or lascivious acts with a child and the child is fourteen or fifteen years old, and the person is at least ten years older than the child can be punished by imprisonment by up to three years.
