California Joyriding Charges and Penalties
What is Joyriding and how is it different from Theft?
Any person who drives or takes a vehicle not his or her own, without the consent of the owner, and with intent either to permanently, or temporarily deprive the owner of his or her title to or possession of the vehicle, whether with or without intent to steal the vehicle, or any person who is a party or an accessory to or an accomplice in the driving or unauthorized taking or stealing of the vehicle is guilty of joyriding.
Joyriding is charged as theft in California.
There are different “levels” of theft in California, grand theft is one of the most serious levels of theft. Grand theft is when money, labor, or real or personal property taken is of a value exceeding $950.00.
It is important to note that you can be charged with other crimes as well at the same time, so you can be charged with theft and joyriding. Examples include borrowing a friend’s car without permission or hotwiring a car.
As there can be multiple charges it is important to have legal counsel represent you who is knowledgeable in the law.
What is the Punishment?
Joyriding is often punished as a misdemeanor, which is punishable by imprisonment for up to one year, a fine of $5,000.00, or both. There are instances where the penalties are increased to a felony level. This includes driving an ambulance, police vehicle, or having prior felony convictions dealing with theft. A felony is punishable by imprisonment for up to three years, and an increased fine, or both.
Even as a Defendant, you still have Rights! Make sure yours were not violated!
Even as an individual facing criminal charges, you have rights, and it is important to know those rights and make sure that they were not violated in any way when you were arrested or charged. Without extensive knowledge of your rights when it comes to police searches, Miranda rights, and your rights when it comes to arrest, it is extremely difficult to get a dismissal or reduction. Do not try to fight these charges on your own—Weber Law is ready to help you today.
