California Forgery Charges and Penalties
What is Forgery?
In California forgery can be defined as:
• Every person who, with the intent to defraud, counterfeits or forges the seal or handwriting of another; or
• Every person who, with the intent to defraud, falsely makes, alters, forges, or counterfeits, utters, publishes, passes, or attempts or offers to pass, as true and genuine, any of the following items, knowing the same to be false, altered, forged, counterfeited.
Examples of forgery include signing another person’s name to a document like a check, will, or contract. Other examples include signing the name of a doctor when writing a fake prescription or endorsing a check when it is written to someone else.
What is the Penalty?
The penalties for forgery can include not only jail time but a hefty fine. The punishment depends on how much money the forgery is valued at. It is a misdemeanor offense if the value does not exceed $950.00 and is punishable by imprisonment for up to one year, a fine, or both.
If the value exceeds $950.00, it is considered a felony offense and is punishable by potentially longer imprisonment, a fine, or both.
As the sentence can vary so greatly, it is important to have knowledgeable legal counsel who can advocate for the lowest sentence for you.
Even as a Defendant, you still have Rights! Make sure yours were not violated!
Even as an individual facing criminal charges, you have rights, and it is important to know those rights and make sure that they were not violated in any way when you were arrested or charged. Without extensive knowledge of your rights when it comes to police searches, Miranda rights, and your rights when it comes to arrest, it is extremely difficult to get a dismissal or reduction.
