Every person who, with the intent that the crime be committed, solicits another to offer, accept, or join in the offer or acceptance of a bribe, or to commit or join in the commission of carjacking, robbery, burglary, grand theft, receiving stolen property, extortion, perjury, subornation of perjury, forgery, kidnapping, murder, rape, arson, or assault with a deadly weapon or instrument or by means of force likely to produce great bodily injury, or, by the use of force or a threat of force, to prevent or dissuade any person who is or may become a witness from attending upon, or testifying at, any trial, proceeding, or inquiry authorized by law, is guilty of criminal solicitation.
There are main factors to this crime that must be met, which include request that the crime be committed, intent that the crime be committed, and communication that the crime be committed.
Examples of criminal solicitation include but are not limited to hiring someone to kill your spouse, asking someone to steal something from you, or even asking someone to lie on the stand for you.
What is the Penalty for Criminal Solicitation?
Every person who, with the intent that the crime be committed, solicits another to offer, accept, or join in the offer or acceptance of a bribe, or to commit or join in the commission of carjacking, robbery, burglary, grand theft, receiving stolen property, extortion, perjury, subornation of perjury, forgery, kidnapping, arson, or assault with a deadly weapon or instrument, or by means of force likely to produce great bodily injury, is punishable by imprisonment for not more than 1 years, a fine of not more than $10,000.00, or both.
Every person who, with intent that the crime be committed, solicits another to offer, accept, or join in the offer or acceptance of a bribe, or to commit or join in the commission of murder, shall be punished by imprisonment of three to nine years.
Every person who, with the intent that the crime be committed, solicits another to offer, accept, or join in the offer or acceptance of a bribe, or to commit or join in the commission of rape by force or violence, sodomy by force or violence, or oral copulation by force or violence, shall be punished by imprisonment for two to four years.
