What is Criminal Attempt?
Every person who attempts to commit any crime, but fails, or is prevented from committing that crime, is guilty of criminal attempt.
Examples of criminal attempt include but are not limited to planning and attempting to rob a bank or planning and attempting to murder someone. Another example includes putting a lipstick in your purse with the intent to steal it and getting caught.
What is the Penalty for Criminal Attempt?
The punishment for criminal attempt depends on the crime that was attempted.
If the crime attempted is punishable by imprisonment, the person guilty of the attempt shall be punished by imprisonment for up to one-half of the sentence that the crime attempted is usually punished with.
For example, Burglary in the second degree is punishable by imprisonment for up to one year. Attempted burglary could be punishable by imprisonment for up to six months.
However, if the crime attempted was premeditated murder, the punishment could be life imprisonment without the possibility of parole. If the crime attempted was premediated murder of a peace officer or firefighter, the punishment is life imprisonment without the possibility of parole.
If the crime is divided into degrees, an attempt to commit the crime may be defined by any of those degrees and punished by any of those punishments.
