California Child Abuse Charges and Penalties
What is Child Abuse?
Any person who willfully inflicts upon a child any cruel or inhuman corporal punishment, or an injury resulting in a traumatic condition, is guilty of child abuse.
Examples of child abuse include shaking a baby when it will not stop crying, withholding food for days as a punishment, intentionally breaking a child’s bone, letting a child eat or drink spoiled food, withholding medical care in some instances, burning a child as a punishment, locking them in a closet as a punishment, holding them under water as a punishment, locking them outside in inclement weather, suffocation, and head injuries.
As there are so many elements that can incorporate child abuse, it is important to have a legal counsel who knows and is comfortable working with all aspects of the crime.
What is the Penalty?
A person who is found guilty of child abuse can be imprisoned for up to six years, fined up to $6,000.00, or both. If it is the second conviction or more, the person can be imprisoned for an additional four years.
There are instances where probation can be granted, depending on the sentencing court; it is important to have legal counsel who is able to effectively advocate for you. If probation is granted, it must be for at least thirty-six months, and could also include stay away conditions from the victim, as well as could involve having to attend a child abuser’s treatment counseling program.
The sentence can vary, and it is important to have a legal counsel who is knowledgeable regarding a realistic sentence for the crime of child abuse. Do not fight for this on your own.
Even as a Defendant, you still have Rights! Make sure yours were not violated!
Even as an individual facing criminal charges, you have rights, and it is important to know those rights and make sure that they were not violated in any way when you were arrested or charged. Without extensive knowledge of your rights when it comes to police searches, Miranda rights, and your rights when it comes to arrest, it is extremely difficult to get a dismissal or reduction. Do not try and fight these charges on your own; Weber Law is ready to help you today.
